What should you do if you're involved in an automobile accident?
Usually you are shaken up, frightened and upset. Sometimes there is a loss of consciousness and it takes a few seconds and sometimes a few minutes until you are fully aware of what has happened. Quite often there is immediate pain, headaches, neck pain and back pain are the most common initial complaints. Sometimes symptoms of pain do not appear until after hours or days have passed. If you are able to you should get insurance information from the person who caused the accident. Take pictures of the accident with your cell phone or a camera. Pictures of the vehicles, pictures of the surrounding intersection, traffic lights and traffic lanes involved in the accident.
Make note of the conditions at the time of the accident. Were the conditions dry or was it wet and/or raining. Note the time of the day the accident occurred on.
Try to determine if there were any collisions inside of your vehicle. Did you hit your head against anything? Did the airbag deploy? Did you strike your shoulder against the door or window? Did your chest strike the steering wheel? Do you have abrasions across your chest and shoulder from the seatbelt?
Were there any external collisions other than the initial impact? What is your vehicle forced into a another car, a signpost, a curb, a median or a tree?
Always call the police! If you were injured at the scene of the accident you should be examined by emergency personnel immediately. They will determine if you should be transported to a hospital via ambulance.
Report the accident to your insurance carrier immediately. If you are not at fault in the accident your insurance rates will not go up.
Get an examination as soon as possible. According to Florida law you must be examined within 14 days of the accident or you have no coverage.
Most individuals have $10,000 worth of coverage which is provided by Florida's no-fault personal injury protection (PIP). You are allowed $2500 of initial coverage. An additional $7500 of coverage is available if you have a determination of emergency medical condition (EMC). Your insurance company will pay 80% of your chiropractic and/or medical treatment following an accident. The additional 20% is your responsibility.
If you have an attorney representing you he will deal with your insurance company and the insurance carrier of the person who caused the accident directly. You should not discuss your injuries and/or treatments with any insurance adjuster. Tell them to talk to your legal counsel and tell them that your treating physician will provide them with reports concerning your accident related complaints and any diagnostic studies that are performed. Only discuss the repair and/or replacement of your vehicle with the insurance adjusters. Do not speak directly to the insurance adjuster of the at fault party.
In most instances, it is better to have legal representation then to try and negotiate with the insurance companies yourself. The insurance companies have multiple attorneys who will be advising them. You should have the same protection.
Most patients/injured parties will have no out-of-pocket expense. Your insurance will cover lost time from work, medical treatments, chiropractic treatments and examinations. Your attorney will negotiate a settlement based on your injuries and the amount of bodily injury coverage available. Your attorney will determine how much money is available from the settlement to pay the attorney fees, the outstanding medical bills, and the amount available to cover your pain and suffering. Frequently the attorney will have to negotiate a settlement and reduction of fees between the medical providers and may even have to lower his own fees in order to settle the case. If the settlement is $10,000 and the outstanding balance is $15,000 your attorney will have to apportion payments at a reduced amount in order to settle the case. The attorney cannot settle the case until he explains the settlement amounts to you and you agree to accept the settlement. Many times the settlement amount is sufficient enough to cover all of the expenses and provide the patient with compensation for pain and suffering.
The best way to protect yourself in addition to the $10,000 of PIP coverage is to have what is termed "uninsured motorist coverage". This coverage provides for medical coverage for accidents caused by uninsured or underinsured motorists. This coverage is usually inexpensive and gives you an extra layer of protection. It is also beneficial to have "med pay coverage" which pays your medical expenses over and above the $10,000 of PIP coverage. There is an additional layer of coverage call an "umbrella policy" which is available for extreme injuries and expenses over and above the other coverage.

Considering the number of drivers that have no coverage or insufficient coverage to protect you, you should always protect yourself!
